TERMS AND CONDITIONS
For purposes of these Terms and Conditions, the terms “We”, “Us” and “Our” refer collectively to "Ikaria WILD RetreaT" and its respective owners, employees, affiliates, officers, directors, successors, representatives, assigns and also to the Team and exploration leaders of Ikaria WILD Retreat.
Please read these Terms and Conditions, and if you accept them, then submit your Application.
GENERAL INFORMATION FOR IKARIA WILD retreat 2019
Each Ikaria Wild Retreat 2019 Includes: hotel accommodations if hotel option is chosen; welcome dinner, daily environmental presentations and discussions about the Greek islands and seas, evening shares, walks, excursions, visit to a winery, live music event (schedule permitting), and other activities.
Each Ikaria Wild Retreat 2019 Does Not Include: hotel accommodations if option is not chosen; airline travel and other transportation costs to/from Ikaria and to/from participants' hotels; all meals/food expenses not expressly stated as being included; passport/ visa fees; all other personal expenses; travel insurance and medical coverage.
All participants must be 18 years or older.
General Condition: Ikaria Wild Retreat 2019 includes an active exploration of Ikaria Island. It requires some physical activity and moderate level walks in summer days. Participants should have the ability to walk on rocky, uneven and loose ground, and moderate uphill/downhill routes. This retreat is not suitable for anyone with a serious medical condition or limited mobility. This retreat is also not suitable for anyone who does not like to be or has a medical condition in high altitudes or on roads/paths without guardrails.
DEPOSITS, REFUNDS AND CANCELLATION POLICY
If we receive and approve your reservation application, you will receive an invitation to join an Ikaria Wild Retreat 2019. The invitation will include further details about Ikaria Wild Retreat 2019, and will include method(s) of payment. You then will have seven (7) days to confirm your participation with a deposit of $200.00.
Once confirmation to you has been given that we received your deposit, you will be required to send in the remaining amount due within fourteen (14) days after sending in your deposit, or before thirty (30) days prior to the start of the Ikaria Wild Retreat 2019, whichever date is later. If you sign up with less than 30 days to the start of Ikaria Wild Retreat 2019, then the full amount will be due at once.
We reserve the right to cancel any Ikaria Wild Retreat 2019 if there are insufficient registrations (less than six (6) participants) and the trip therefore becomes not economically feasible for us to host it. A cancellation due to insufficient participation will result in a full refund of your payments made to us.
In addition to the above, no refunds of deposits received will be granted for any reason other than a cancellation of Ikaria Wild Retreat 2019 by Us due to safety or other reasons outside of our control.
If We need to cancel any Ikaria Wild Retreat 2019, We and all tour operators providing services for the Ikaria Wild Retreat 2019 have no responsibility for any expenses, including any non-refundable expenses, incurred by the participants in preparing for the Ikaria Wild Retreat 2019 (e.g., airline tickets, ferry tickets, car rentals, personal reservations, purchases made for planning to travel, packing expenses, etc.) or for any additional arrangements should the participant embark prior to the scheduled group departure date. Any airline tickets, ferry and other tickets issued are subject to the carriers’ refund policies. We shall not be liable for any company or travel carrier (e.g., airlines, ferries, vehicles, etc.) cancellation or penalty incurred by participants.
Late Arrivals and Early Departures
We will try to accommodate all late arrivals and early departures communicated to us at the time that an application to join an Ikaria Wild Retreat 2019 is submitted to us. However, arriving late or leaving an Ikaria Wild Retreat 2019 in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of the Ikaria Wild Retreat 2019.
DOCUMENTATION AND TRAVEL CARRIERS
Participants are responsible for obtaining any documents required for their participation in the retreat such as a valid passport, visas, and any other documents. Failure to obtain documents does not negate any part of provision of these Terms and Conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the participant’s responsibility.
Baggage and personal effects are at all times the sole responsibility of the participant(s).
RULES AND REGULATIONS
It is important that We and all participants respect Ikaria Island and its local culture and environment. If a participant acts in a way that is injurious to himself or herself, people of Ikaria, other participants on the trip, or breaks any local laws, rules or regulations, or generally conducts himself or herself in a way that is disruptive to an Ikaria Wild Retreat 2019 or the local environment, we reserve the right to dismiss the participant without refund. Use of any illegal drugs or mistreating the natural environment of Ikaria are example causes of dismissal. Participants dismissed early or who choose to leave for any reason, including sickness, personal emergencies or injury, will be responsible for all medical costs, and will absorb travel and related costs associated with an unscheduled departure.
HEALTH REQUIREMENTS AND SAFETY CONSIDERATIONS
This exploration of Ikaria may be rugged at times and requires good physical conditioning. Participants must be in good physical and mental health. Any physical condition, diet, or treatment requiring special attention must be reported in writing when the reservation is made. We cannot guarantee that we will be able to reasonably accommodate all needs. We encourage participants to consult a doctor for specific medical advice about any activities or destinations. If you have any questions regarding the physical demands of a program, please let Us know. We assume no liability regarding provision of medical care. It is the participant’s responsibility to understand the coverage and limitations of his/her travel and health insurance, and to procure additional medical insurance as needed or preferred.
By registering for an Ikaria Wild Retreat 2019, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for him/herself or other participants. We reserve the right in our sole discretion to accept, decline to accept, or remove any participant on an Ikaria Wild Retreat 2019.
MEDICAL INSURANCE AND COVERAGE
Participant certifies upon submitting his/her deposit to Us that s/he has medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the participant, or that in the absence of this medical insurance coverage, the participant agrees to pay all costs of rescue and/or medical services as may be incurred on the participant’s behalf.
The itinerary for the Ikaria Wild Retreat 2019 has been thought out with great care to try to provide an extremely rewarding experience for participants. Every reasonable effort will be made to operate each Ikaria Wild Retreat 2019 as planned. However, alterations may still occur after final itineraries are sent. We reserve the right, without penalty, to make changes to the Itinerary whenever, in our sole discretion, conditions warrant or if they deem it necessary for accommodating local, conditions, the comfort, safety or convenience of participants.
Assumption of Risk
Ikaria Wild Retreat 2019 includes risks associated with foreign travel and a remote island with a diverse natural environment, mountains, winding roads and other physical terrain conditions. Risks may include, but are not limited to, those associated with local transportation, terrain changes, mountain altitudes, locally marked (and sometimes unmarked) footpaths, nature walking, communications issues, accommodations and hotels, unfamiliar foods, weather, and emotional stress due to travel and circumstances which may be unfamiliar to the participant.
By registering for an Ikaria Wild Retreat 2019, the participant acknowledges that he/she is aware that travel he/she is undertaking for the Ikaria Wild Retreat 2019 involves the risks associated with foreign travel and a remote island, as well as other potentially dangerous activities, risk of illness, injury or death which may be caused by forces of nature, illness, or by the negligent or willful conduct of third parties. The participant further acknowledges that weather conditions may be severe, adverse and/or unpleasant and that medical services or facilities may not be readily available or accessible or consistent with standards that the participant is used to in his/her home country.
We shall not be held liable for any damage to, or loss of, financial means, property or injury to, or death of, the participants and any other persons occasioned directly or indirectly by an act or omission by Us or by any other provider and any loss or damage due to delay, cancellation, or disruption in any manner caused by any other conditions, the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, weather conditions, fire, wind, flood, sea conditions, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond our control. The participant waives any claim against Us and/or Our exploration leaders for any such loss, damage, injury, or death and for any other harm whatsoever.
If the participant has a complaint, he/she should first inform an exploration leader so that s/he can attempt to rectify the matter. If the participant is still dissatisfied, s/he should submit the complaint in writing to Us within 30 days of the completion of the expedition.
Any controversy or claim arising out of or relating to these Terms and Conditions, Our website, or any other documents, correspondence or literature concerning an Ikaria Wild Retreat 2019, or the breach thereof, including without limitation any claim related to breach of contract, tort, illness, injury, or death, shall be subject to the following conditions: (i) the dispute will be governed by the laws of the State of Connecticut, USA; (ii) the parties agree that they will attempt in good faith to settle any and all disputes arising out of, under or in connection with this Agreement, including without limitation the validity, interpretation, performance and breach hereof, through a process of mediation in New Haven, Connecticut, USA under the supervision of a mutually agreed upon mediator; (iii) in the event that mediation fails to settle such a dispute, the parties agree that they will proceed to arbitration in New Haven, Connecticut, USA using one arbitrator pursuant to the then existing rules of the American Arbitration Association; (iv) participants may not file or engage or participate in any class action suit against Us; and (v) the maximum amount of recovery to which a participant will be entitled under any and all circumstances will be the published price of the participant’s individual participation in Ikaria Wild Retreat 2019. This agreement to arbitrate does not waive or modify any liability release agreed by the participant.
CHANGES TO THESE TERMS AND CONDITIONS
Except for the Dispute Resolution section about, we reserve the right, without penalty or any other obligation owed, to make changes to any part of these Terms and Conditions or to include additional Terms and Conditions whenever, in our sole discretion, conditions warrant or if We deem it necessary for accommodating local, conditions, the comfort, safety or convenience of participants.
Additional Terms and Conditions may also apply to this retreat and will be available to participants prior to the required deposit.
